Technically yes you should get a new xbox but you also have to put in the fact that they warrenty may or may not cover it or how old it really is.so you should be able to send it back to them and have microsoft replace it. however they will try to find something that they warrenty doesnt support so that they dont heave to get you a new one becuase they really dont want to, or something.
so i suggest you can either view their online warrenties or call up their support and hear from them if you can or not. odds are you can get a new one!
i have luckily not had any probs with mine so far but as far as recieving a new XBOX it could be a possibility normally companies will replace with a refurbished/repaired one after all they arent just gonna stockpile em or thrrow em away
i sent away my TFT monitor when it broke within warranty they sent me a repaired one which was still faulty and was covered in dirt and crap so after calling them and complaining i recieved a brand new one

You receive a refurbished one. How do I know? All xbox's come with free one months on them. All you do is go to make a silver account and it will tell you if your are eligible. If you dont have any its because some previously used them all! Unless they dont put them on new xboxs. Which they probably still do!

I've had mine repaired twice, each time I got a different one. I don't know if it was brand new or refurbished, but they both had different serial numbers.
